TERMS AND CONDITIONS

The following Terms and Conditions together with GCap Media plc's ("GCap Media") general and competition terms and conditions (which can be found at the station’s website) apply to ‘XFM’s All Day Breakfasy” on Xfm radio competition ("the Competition") which will run for 26 days from 27th May 2008 (or earlier in the circumstances provided for below) on week days and weekends (excluding any bank or public holidays) only ("the Duration") on Xfm

 
All Day Breakfast is executed once an hour in most (but not all) hours, listeners have to text ‘breakfast’ to 83XFM when invited by the presenter in order to enter.

By entering this Competition, an entrant (each an “Entrant”) will be deemed to have understood these rules along with the general and competition terms and conditions and to be bound by them.

1.   Details of the Competition
1.1 For the Duration of the Competition, listeners to all the Participating Radio Stations will be invited to enter the Competition by registering their details via a text message line or lines (each a “Text Message Line”) as described below.
1.2 To enter the Competition an Entrant must send a text message to the relevant Text message Line during a specified period during each contesting round (“Round”) of the Competition. Each Round is intended to take place once each hour in the following hours: 8am-12am (excluding 9am & 1pm) on Weekdays; 7am-5pm on Saturdays and Sundays but subject to change at the discretion of GCap Media. When Registering via a Text Message Line an Entrant must send a text message with the word “Breakfast” to 83xfm. The Participating Radio Stations will announce each day and for each Round the specific periods during which each relevant Text Message Line is open]. The number of tickets to be one will vary each hour, and will be specified at the time of execution.
1.3 Each day the Competition is run, for each Round of the Competition, the number of Entrants that equal the number of tickets being given away will be chosen at random from all Entrants who have Registered their name and telephone number via the relevant Text Message Line (which shall be publicised from time to time by each Participating Radio Station) for that Round. Registrations are only valid for each Round as described in clause 1.2 above.  It is necessary to re-register to take part in further Rounds of the Competition.
1.4 Subject to the provisions of these Terms and Conditions, each day the Competition is run, in respect of each Round, the entrants who are chosen at random (“Player”) as described in clause 1.2 and 1.3 above will be called on air soon after the closure of the Text Message Line for that Round and before commencement of the next Round. At the beginning of every contest hour the gig tickets being given away, including quantities of, will be announced Listeners will be asked to text in when they hear the ‘cue to call’ – a winner(s) will be chosen at random and taken to air. Winners must be available to take a call at the time of winning. All matters relating to the selection at random of Entrants and all other matters relating to the Competition will be at the discretion of GCap Media and the Participating Radio Stations.  A winner of a Prize shall be a Winner for the purposes of these terms and conditions. 
 1.5 SMS text entries are charged at the network operators standard charge.

2.     Eligibility
2.1   Any person using a telephone which is not his or her own should ask for the permission of the owner of the telephone before sending an SMS text message to the Text Message Line.
2.2 Any employees of GCap Media, their immediate family or any other persons directly connected with the Competition are unable to enter into the competition.
2.3 The Competition is open to residents of the UK and Northern Ireland only.
2.4 Notwithstanding that a Winner has been declared, if GCap Media discovers before the delivery of a Prize that for any reason under these terms and conditions the Winner should have been ineligible to enter the Competition or the entry should have been declared invalid, GCap Media reserves the right to determine that the Winner is disqualified.
2.5 There is no limit on the number of text messages that can be sent to the Text message Line, but Entrants are referred to the costs of calls and text messages referred to above.
2.6 If in the course of a telephone call the telephone line drops out or breaks up GCap Media’ retains the right to proceed to another Player. In such event, GCap Media and the Participating Radio Stations will not be responsible for the awarding of any Prize to the caller whose line dropped out or broke up.  GCap Media and the Participating Radio Stations shall not be responsible for any failure on behalf of an Entrant whose calls or text message are not received by GCap Media or a Participating Radio Station. 
2.7 An Entrant must participate in the Competition himself or herself.  In the event that a party other than the Entrant attempts to enter the Competition on behalf of that Entrant (whether disclosed or not), that entry will be forfeited and no Prize will be delivered.
2.8 The Competition will be supported by promotional activity on the Participating Radio Stations’ websites, and via SMS message where a person has requested such messages.  The terms of participation in any activity on the Website or via SMS message will be made available on those platforms.
2.9  A person or people at the same residential address may not win more than one prize valued at £100 or greater (subject to each individual stations discretion) within a one year period following the first win, nor shall any member of such persons family (including, but not limited to, aunts, uncles, cousins, grandparents etc.)

3.  Prize
Each hour of the competition there will be a different prize which will be announced at the top of each execution hour. On the announcement of each prize, the presenter will outline what the prize package includes. Transport and accommodation will not be provided.
3.1 All decisions of the GCap Media and Participating Radio Stations’ representatives will be final and binding on the Entrants and no correspondence will be entered into.
3.2 Winners will be contacted with their prize details by the Participating Radio Station within 28 days after notification.
3.3    The name of the Winner(s) (if there is one) will be announced on one or more Participating Radio Stations on the day of the Winner's successful entry.

2. hello, just thought i would ask if i could have a golden ticket to the all day breakfast as this year has been really rubbish for me!
   i hardly ever get weekends off from my job, and mt staff are crap! i just want a whole saturday off, and 2 do somefin cool. i think 6 months without a weekend off deserves some pay back, help me out on this one.
   the football season starts again in a few weeks, so any chance i have is limited!

5. I heard that I had won a pair of tickets to see Paul Weller and there can't be too many people with my name getting about. I haven't heard anything from XFM though....very worried. What's the go, all my friends are ringing me wanting to go and i'm not even sure whether i've got tickets.

6. I missed the phone call to say I was to recieve 2 tickets to Paul Weller and was left a voicemail by Cheeky Pete. I work in a school and can rarely answer cals between 9 & 3. Hope I can still go...
